Hawaii May Start to Fine Smelly People

Bill targets pungent riders of Honolulu's transit system

The City Council is considering a bill that will make it illegal to "bring onto transit property odors that unreasonably disturb others or interfere with their use of the transit system, whether such odors arise from one's person, clothes, articles, accompanying animal or any other source."

Councilman Rod Tam, a co-sponsor of the bill, explained why it is needed:


"As we become more inundated with people from all over the world, their way of taking care of their health is different. Some people, quite frankly, do not take a bath every day and therefore they may be offensive in terms of their odor."

Other prohibitions in the bill include spitting, urinating or being intoxicated.

Tam last year unsuccessfully sought to pass a bill addressing the issue of sleeping at bus stop benches, and this year's bill is considered a more comprehensive take on that concern.


Tam said last year's bill failed after opponents wrongly characterized it as an anti-homeless measure when it was meant to ensure the safety and comfort of bus passengers.

ACLU CONCERNED

The local chapter of the American Civil Liberties Union and council member Charles Djou said they are worried the bill is onerous and too broadly worded.


"We are obviously concerned about laws that are inherently vague, where a reasonable person cannot know what conduct is prohibited," said Daniel Gluck, of ACLU Hawaii. "Vague laws — like the proposed 'odor' ban — open the door to discriminatory enforcement based on an officer's individual prejudices."

Under the bill, a person found in violation may be ordered to leave transit property and issued a summons or citation by a police officer. If convicted, a person could be fined up to $500, spend up to six months in jail, or be both fined and jailed.

The bill will be heard at 9 a.m. Thursday by the Council Transportation Committee.

So what do you all think of this? Personally, I think it's ridiculous and see it as yet another attempt at keeping the homeless down. Tam's bill last year was almost as outrageous as this one and was clearly anti-homeless even if he had only good intentions in mind. He seems willing to further limit the homeless to provide just a little extra comfort to everyone else.

Stank people are pretty nasty. However I don't think it's right to actually fine them...Just mock them until they cry and change their bathing patterns instead.

Stinky people are just awful. I'm reminded of the time I walked into a busy and packed EB games, and walked straight out immediately with a detached nose and a puke-face.

I don't think anywhere will ever pass a bill/law to fine people who stink. It's too opinion based, like Stixx said. Some people also can't help it; not meaning to stereotype, but a large amount of obese people (no pun intended) generally have "That" stink. Not all of them though.

Governor of Hawaii. That's like, what? One step above Alaska? And we all know how the last one up there was.... I'll politely decline.

No, because people actually want to go to Hawaii.

Alaska's a shithole, no offense to anyone with family/friends there. Same goes for Texas. Ironic that both of them want to secede from the US, I really wouldn't care if either did, lol

Plus Chuck Norris says he'd run for President of Texas if it seceded. Think of how epic it would be to see Chuck Norris running a country.

It'd be neat if Canada owned Alaska. Not because I feel as if it magically belongs to us or anything, but just because, geographically, it would make Canada look nicer even on maps. Plus, I like Alaska in theory. I'm sure I'd love it if I ever visited and didn't encounter Sarah Palin at all.

Size-wise, perhaps, but in all honesty, there's only about 2 square feet of liveable space in Alaska. Plus, it's where Sarah Palin lives.

But don't blame me, blame the Water Temple. :water: :argh:
